This Terms and Conditions Agreement ("Agreement") sets forth legally binding terms between you ("Customer," "User," or "You") and DIYIDPhoto.com ("Company," "we," or "us") regarding your use of our passport and visa photo service ("Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to comply with these terms. If you do not agree with any part of this Agreement, you must not use the Service.
Use of Service
1.1. The Service allows users to generate biometric passport and visa photos online, including digital and printable formats, in compliance with government standards.
1.2. You are solely responsible for ensuring that the photos generated through the Service meet the specific biometric requirements of the relevant authorities (e.g., embassies, immigration offices) for your visa or passport application.
1.3. You agree not to use the Service for any unlawful, fraudulent, or prohibited purposes, including but not limited to creating counterfeit documents or violating privacy laws.
Refund Policy
2.1. Eligibility for refunds and the process for requesting them are governed by our separate Refund Policy. Please review this policy for detailed information on scenarios such as authority rejection, technical errors, or double charging.
User Conduct
3.1. You are liable for all content or photos uploaded or generated using the Service. You agree not to upload material that is illegal, harmful, defamatory, offensive, or infringing on third-party rights (e.g., copyright, privacy).
3.2. By using the Service, you consent to the processing of your uploaded images and personal data in accordance with our Privacy Policy.
Intellectual Property
4.1. The Service, including but not limited to software, algorithms, designs, logos, and text, is the intellectual property of the Company and protected by copyright, trademark, and other intellectual property laws.
4.2. We grant you a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose (i.e., generating compliant passport/visa photos). You may not sublicense, modify, or redistribute the Service or its components.
Limitation of Liability
5.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR SUITABLE FOR YOUR SPECIFIC APPLICATION REQUIREMENTS.
5.2. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, PROFITS, OR OPPORTUNITY) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
6.1. You agree to indemnify, defend, and hold the Company, its affiliates, and their respective employees, contractors, and agents harmless from any claims, liabilities, damages, costs, or expenses (including legal fees) arising out of or related to: Your violation of this Agreement or applicable laws; Your use of the Service, including uploaded content; Your infringement of any third-party rights.
Modifications to Service
7.1. We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. We are not liable to you or any third party for any modifications, suspensions, or discontinuations of the Service.
Governing Law
